Health and Safety Law Updates

What does this mean for you and your company?


On June 12 2023, there was an amendment to the Health and Safety at Work Act regarding Health and Safety Representatives and Committees.


This is how it will affect your business…


  1. Regardless of the type of work your business carries out, if one of your workers asks for a Health and Safety Representative, the business must initiate an election.

  2. If 5 or more workers or a Health and Safety Representative, ask for a Health and Safety Committee, the business needs to form one.

In both above situations, the business can opt to elect Health and Safety Representatives or form a Health and Safety Committee without the request from their workers.


Prior to this amendment, the risk profile of the business and the number of staff tended to dictate whether a Health and Safety Representative or Committee were required. This is no longer the case.
